Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and LinkTrip LLC, doing business as LinkTrip ("LinkTrip," "we," "us," or "our"), and govern your access to and use of LinkTrip's websites, applications, trip pages, tools, products, and services, including any RSVP tools, guest management tools, custom-date RSVP features, payment-tracking features, booking-link features, cover photo uploads, itinerary tools, and related services we provide (collectively, the "Service").

By creating an account, purchasing a trip page or feature, creating or managing a trip, RSVPing to a trip, submitting information through a LinkTrip page, clicking an invite link, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to create an account, host a trip, purchase LinkTrip features, or otherwise use the Service.

The Service is not intended for children under 13. Users may not knowingly submit personal information about a child under 13 unless they are the child's parent or legal guardian and such submission is permitted by applicable law and our Privacy Policy.

Hosts are solely responsible for ensuring they have proper consent before collecting, entering, uploading, or sharing information about any minor guest.

2. What LinkTrip Is

LinkTrip is a group-trip planning and organization platform. The Service allows hosts to create trip pages, share private invite links, collect RSVPs, organize guest details, track arrival and departure dates, collect lodging and flight information, coordinate activities, share estimated costs, upload cover photos, add booking links, and track payment status.

LinkTrip is an organizational software tool only.

LinkTrip is not a travel agency, tour operator, hotel, airline, rental company, transportation provider, event planner, payment processor, escrow service, financial institution, broker, fiduciary, insurer, or emergency service.

We do not arrange, sell, book, reserve, operate, supervise, guarantee, or control any travel, lodging, transportation, event, activity, reservation, payment arrangement, or third-party service between hosts, guests, or third-party providers.

3. No Travel Agency or Seller-of-Travel Services

LinkTrip does not sell, provide, furnish, arrange, book, reserve, package, broker, or contract for travel services, lodging, transportation, activities, tours, cruises, flights, vacation packages, travel insurance, or other travel-related services.

Hosts and guests are solely responsible for making their own bookings directly with third-party providers. LinkTrip does not control and is not responsible for any third-party provider, booking platform, airline, hotel, vacation rental, rental company, tour operator, activity provider, transportation provider, or payment provider.

Nothing on the Service should be interpreted as travel advice, a travel recommendation, a guarantee of availability, a promise of pricing, or an offer to sell travel services.

4. Accounts and Security

You agree to provide accurate, current, and complete information when creating an account or using the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify us immediately if you believe your account has been accessed without authorization. We are not responsible for losses resulting from your failure to secure your account, device, password, invite links, or other access credentials.

We reserve the right to refuse, suspend, restrict, or terminate accounts at our discretion if we believe an account has been misused, compromised, used fraudulently, or used in violation of these Terms.

5. Hosts

A "Host" is a user who creates, manages, edits, or shares a trip through LinkTrip.

Hosts are solely responsible for:

  1. The accuracy of all trip details, dates, deadlines, prices, descriptions, rules, lodging information, activity information, payment instructions, and guest requirements.
  2. Communicating clearly with guests about trip expectations, costs, payment deadlines, cancellation rules, refund rules, lodging arrangements, transportation, activities, and any risks.
  3. Ensuring they have the right to share any booking links, photos, names, guest information, payment information, screenshots, or other content added to the Service.
  4. Obtaining any required permissions, licenses, permits, waivers, insurance, authorizations, or approvals related to the trip.
  5. Handling all disputes, cancellations, reimbursements, guest payments, chargebacks, no-shows, late payments, and disagreements between hosts and guests.
  6. Protecting guest information and using it only for legitimate trip-planning purposes.
  7. Ensuring their use of LinkTrip complies with all applicable laws, third-party terms, and payment-provider rules.

Hosts may not use LinkTrip to mislead guests, collect unauthorized payments, run scams, sell illegal services, promote unsafe activities, or create trips that violate applicable law or these Terms.

6. Guests

A "Guest" is a user who RSVPs to, views, or submits information for a trip through LinkTrip.

Guests are responsible for:

  1. Providing accurate and complete RSVP, contact, travel, lodging, and payment-status information.
  2. Reviewing all trip details, costs, deadlines, cancellation terms, refund rules, and host instructions before participating.
  3. Communicating directly with the host regarding questions, payment obligations, refunds, cancellations, itinerary changes, or trip-related disputes.
  4. Making their own decisions about travel, safety, insurance, lodging, transportation, and participation in activities.
  5. Reviewing all third-party booking terms before making any booking or purchase.

LinkTrip does not verify the accuracy of trip details provided by hosts and does not guarantee that a host, guest, vendor, booking link, activity, lodging, flight, or payment arrangement is legitimate, safe, available, refundable, accurate, or suitable.

7. LinkTrip Fees

Hosts may be charged a one-time fee per trip, plus additional fees for optional tools, upgrades, guest limits, RSVP features, custom-date RSVP tools, guest contact tools, payment-tracking tools, booking-link tools, or other premium features.

Fees are displayed at checkout before purchase. Unless expressly stated otherwise, LinkTrip fees are non-recurring.

All LinkTrip fees are platform-access fees only. LinkTrip fees do not include travel, lodging, flights, activities, transportation, guest payments, deposits, reimbursements, or third-party booking costs.

Except where required by law or expressly stated in writing by LinkTrip, all fees paid to LinkTrip are non-refundable.

Once a trip page, tool, feature, guest-capacity tier, or upgrade is purchased, the host is responsible for using it appropriately. Failure by a host to use a purchased feature, invite guests, complete a trip, collect payments, proceed with a trip, or receive guest participation does not entitle the host to a refund.

We may change our pricing, packages, features, guest limits, or fee structure at any time. Pricing changes will not affect purchases already completed unless otherwise stated.

8. Host and Guest Payments

LinkTrip does not currently process payments between hosts and guests.

If guests owe money to a host, those payments are arranged and collected directly by the host outside of LinkTrip, including through services such as Zelle, Venmo, Cash App, bank transfer, cash, or other third-party payment methods.

LinkTrip may allow hosts to track payment status, mark guests as paid or unpaid, upload payment screenshots, or organize cost information. These tools are for convenience only.

LinkTrip does not verify whether a payment was actually made, received, reversed, refunded, disputed, owed, late, or complete.

LinkTrip is not responsible for:

  1. Money collected by hosts.
  2. Money owed by guests.
  3. Refunds, reimbursements, deposits, chargebacks, failed transfers, fraud, payment errors, incorrect payment information, or payment disputes.
  4. Any tax reporting or tax obligations related to money exchanged between hosts and guests.
  5. Any third-party payment platform's fees, terms, restrictions, delays, reversals, account holds, or decisions.
  6. Any host or guest's failure to pay or refund money.

Hosts and guests are solely responsible for resolving payment disputes directly with each other and with any third-party payment provider used.

9. Payment Processor Compliance

If LinkTrip uses Stripe or another payment processor to collect LinkTrip platform fees, your payment may be processed by that third-party provider. Your use of that payment processor may be subject to its own terms, policies, prohibited-business rules, restricted-business rules, and compliance requirements.

You agree not to use LinkTrip in any way that would cause LinkTrip to violate the rules or policies of its payment processors, banking partners, app stores, hosting providers, or other service providers.

We may refuse or cancel transactions that we believe may violate applicable law, these Terms, payment-processor rules, or LinkTrip's internal risk policies.

10. Third-Party Booking Links and Affiliate Links

Hosts may add links to third-party services, including flights, hotels, vacation rentals, transportation, activities, restaurants, excursions, ticketing platforms, travel insurance, or other services. These third-party services are not owned or controlled by LinkTrip.

LinkTrip is not responsible for third-party websites, booking platforms, travel providers, vendors, prices, availability, cancellations, delays, safety, refunds, fees, terms, policies, customer service, or representations.

Some links displayed through the Service may be affiliate, referral, or sponsored links. This means LinkTrip may receive compensation if a user clicks a link, creates an account, or makes a purchase through that link, at no additional cost to the user.

Affiliate compensation does not mean LinkTrip controls, endorses, guarantees, recommends, or is responsible for the third-party provider, product, booking, price, refund, cancellation policy, safety, quality, or availability.

Users should review all third-party terms, privacy policies, cancellation policies, refund rules, baggage rules, travel requirements, and fees before making any booking or purchase.

11. Trip Changes, Cancellations, and Travel Risks

Hosts and third-party providers may change or cancel trip details, lodging, flights, activities, reservations, deadlines, prices, or payment expectations. LinkTrip is not responsible for any such changes or cancellations.

Travel involves risks, including illness, injury, theft, property damage, lost luggage, weather events, transportation delays, cancellations, border issues, visa issues, safety concerns, emergencies, and unexpected expenses.

Users are responsible for making their own travel decisions and obtaining any insurance, travel documents, permissions, health clearances, or professional advice they determine is necessary.

LinkTrip does not monitor trips for safety and is not an emergency service. In an emergency, contact local emergency services immediately.

12. No Emergency, Safety, or Supervision Duties

LinkTrip does not supervise trips, verify guests, screen hosts, inspect lodging, evaluate destinations, monitor travel conditions, provide safety advice, or respond to emergencies.

Users are responsible for their own safety, travel decisions, insurance, documents, health needs, and emergency planning.

LinkTrip has no duty to intervene in disputes, emergencies, cancellations, unsafe situations, or conflicts between hosts, guests, or third-party providers.

13. User Content and Uploads

You may submit, upload, or share content through the Service, including trip names, descriptions, photos, guest names, contact information, RSVP responses, travel details, payment screenshots, notes, booking links, activity details, and other materials (collectively, "User Content").

You retain ownership of your User Content. By submitting User Content to LinkTrip, you grant LinkTrip a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, display, process, transmit, modify, and use your User Content as reasonably necessary to operate, improve, secure, and provide the Service.

You represent and warrant that:

  1. You have the right to submit the User Content.
  2. Your User Content does not violate any law or third-party right.
  3. Your User Content is not false, misleading, defamatory, harassing, unlawful, obscene, threatening, discriminatory, invasive of privacy, or otherwise harmful.
  4. Your User Content does not contain malware, viruses, or harmful code.
  5. Your User Content does not include information you are not authorized to share.

We may remove, restrict, or disable access to User Content at any time if we believe it violates these Terms, creates legal risk, creates safety risk, or may harm LinkTrip or its users.

14. No Sensitive Information

Users may not upload or submit Social Security numbers, full bank account numbers, full credit card numbers, government identification numbers, passport numbers, medical records, health information, passwords, or other highly sensitive information unless LinkTrip expressly provides a secure feature for that purpose and such submission is permitted by our Privacy Policy.

Payment screenshots should be redacted before upload and should show only the minimum information necessary to help a host track payment status.

LinkTrip is not responsible for a user's decision to upload unnecessary sensitive information, unredacted screenshots, private documents, or information they were not authorized to share.

15. Privacy and Guest Information

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

Hosts may receive access to guest information submitted through a trip page. Hosts agree to use guest information only for legitimate trip-planning purposes and not to sell, misuse, disclose, spam, harass, or otherwise exploit guest information.

Anyone with access to a private trip invite link may be able to view or submit certain information depending on the trip settings. Hosts are responsible for sharing invite links carefully and limiting access to appropriate guests.

Hosts are responsible for protecting guest information they receive through the Service and for complying with any privacy laws that may apply to their use of that information.

16. Communications

By using the Service, you agree that LinkTrip may send you transactional, administrative, security, service, payment, and account-related communications.

These communications may include emails about your account, trip pages, purchases, RSVPs, feature updates, support requests, legal notices, or changes to the Service.

Marketing communications, if any, will be handled in accordance with applicable law and our Privacy Policy.

17. Acceptable Use

You agree not to:

  1. Use the Service for any unlawful, fraudulent, misleading, abusive, or harmful purpose.
  2. Create fake trips, fake RSVPs, fake payment records, or misleading booking information.
  3. Collect money under false pretenses.
  4. Impersonate another person or entity.
  5. Access or attempt to access accounts, data, systems, or trip pages without authorization.
  6. Interfere with, disrupt, overload, scrape, reverse engineer, or compromise the Service.
  7. Upload malware, viruses, harmful code, spam, or phishing content.
  8. Use the Service to harass, threaten, discriminate against, exploit, or harm others.
  9. Upload content that infringes intellectual property rights or violates privacy rights.
  10. Use the Service for illegal travel services, illegal events, regulated services without proper authorization, or prohibited activities.
  11. Circumvent payment, access, guest-limit, feature-limit, or security controls.
  12. Violate any applicable law, regulation, third-party platform rule, payment-processor rule, or these Terms.
  13. Misrepresent LinkTrip as a travel agency, booking provider, payment processor, escrow service, or organizer of the trip.

We may investigate suspected violations and may remove content, restrict trip pages, suspend accounts, or terminate access at our discretion.

18. Prohibited Trips and Activities

You may not use LinkTrip to organize, promote, facilitate, or collect information for trips, events, activities, or transactions involving:

  1. Illegal goods or services.
  2. Fraudulent, deceptive, or misleading schemes.
  3. Human trafficking, exploitation, or abuse.
  4. Violence, threats, hate, harassment, or discrimination.
  5. Regulated services offered without proper authorization.
  6. Unsafe or unlawful travel arrangements.
  7. Adult sexual services or exploitation.
  8. Illegal gambling, illegal lotteries, or unlawful contests.
  9. Controlled substances or illegal drugs.
  10. Any activity prohibited by our payment processors, hosting providers, app stores, or service providers.
  11. Any activity that creates legal, safety, financial, reputational, or operational risk for LinkTrip.

We may remove or restrict any trip page we believe violates this section or creates unacceptable risk.

19. Intellectual Property

The Service, including LinkTrip's name, logo, design, software, text, graphics, features, functionality, and other materials, is owned by LinkTrip or its licensors and is protected by intellectual property and other laws.

These Terms do not grant you any ownership rights in the Service.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as expressly permitted by LinkTrip in writing.

Subject to these Terms, LinkTrip grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal or internal trip-planning purposes.

20. Feedback

If you submit ideas, suggestions, improvements, feature requests, or other feedback to LinkTrip, you agree that LinkTrip may use them without restriction or compensation to you.

21. Service Availability and Changes

We may modify, update, suspend, discontinue, limit, or remove any part of the Service at any time, including features, tools, pricing, trip settings, guest limits, or integrations.

We do not guarantee that the Service will be uninterrupted, secure, accurate, error-free, or available at all times.

We are not responsible for delays, outages, data loss, feature limitations, service interruptions, bugs, maintenance, third-party service failures, or platform changes.

22. Termination and Suspension

You may stop using the Service at any time.

We may suspend, restrict, or terminate your account, trip page, or access to the Service at any time if we believe you have violated these Terms, created risk for LinkTrip or other users, failed to pay fees, misused the Service, violated applicable law, or engaged in conduct we determine to be harmful, fraudulent, or inappropriate.

Upon termination, your right to use the Service will stop immediately.

Certain provisions of these Terms will continue to apply after termination, including provisions related to fees, User Content, intellectual property, disclaimers, limitation of liability, user release, indemnification, dispute resolution, and miscellaneous terms.

23. User Release

To the fullest extent permitted by law, you release LinkTrip and its owners, officers, employees, contractors, agents, affiliates, service providers, and licensors from any claims, demands, damages, losses, liabilities, costs, and expenses arising out of or related to:

  1. Any dispute between hosts and guests.
  2. Any payment, refund, reimbursement, deposit, chargeback, or financial arrangement between users.
  3. Any travel booking, lodging, transportation, activity, event, reservation, cancellation, delay, injury, illness, property damage, or other travel-related issue.
  4. Any third-party website, vendor, booking platform, payment provider, or service provider.
  5. Any information submitted, omitted, changed, or misrepresented by a host, guest, or third party.

If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

24. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.

To the fullest extent permitted by law, LinkTrip disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and reliability.

LinkTrip does not warrant or guarantee that:

  1. Trip information entered by users is accurate, complete, lawful, or current.
  2. Hosts or guests will act honestly, safely, or lawfully.
  3. Payments between hosts and guests will be made, received, verified, refunded, or undisputed.
  4. Third-party links, vendors, booking platforms, hotels, airlines, rentals, activities, or payment services will perform as expected.
  5. The Service will be uninterrupted, error-free, secure, or free of harmful components.
  6. A trip will occur, be safe, be enjoyable, be properly organized, or meet any user's expectations.
  7. Any booking link, affiliate link, travel provider, or third-party offer will be available, accurate, legitimate, refundable, or suitable.

You use the Service at your own risk.

25. Limitation of Liability

To the fullest extent permitted by law, LinkTrip and its owners, officers, employees, contractors, agents, affiliates, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost savings, lost data, loss of goodwill, personal injury, property damage, travel losses, booking losses, payment disputes, or costs of substitute services.

To the fullest extent permitted by law, LinkTrip is not liable for losses arising from or related to:

  1. Trips, events, lodging, flights, transportation, activities, or third-party services.
  2. Host or guest conduct.
  3. Payments, refunds, deposits, reimbursements, chargebacks, or payment-tracking errors.
  4. Incorrect, outdated, incomplete, or misleading trip information.
  5. Unauthorized access to accounts, invite links, or trip pages.
  6. User Content.
  7. Service interruptions, bugs, errors, maintenance, or data loss.
  8. Third-party websites, apps, platforms, vendors, or payment providers.
  9. Affiliate links, booking links, or third-party recommendations.
  10. Any user's failure to review third-party terms, cancellation policies, refund rules, or travel requirements.

To the fullest extent permitted by law, LinkTrip's total liability for any claim arising out of or related to the Service or these Terms will not exceed the greater of:

  1. The amount you paid LinkTrip for the specific trip or feature giving rise to the claim; or
  2. $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

26. Indemnification

You agree to defend, indemnify, and hold harmless LinkTrip and its owners, officers, employees, contractors, agents, affiliates, service providers, and licensors from and against any claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  1. Your use or misuse of the Service.
  2. Your violation of these Terms.
  3. Your violation of applicable law or third-party rights.
  4. Your User Content.
  5. Your trip, trip page, invite link, host activity, guest activity, payment arrangement, booking link, or third-party transaction.
  6. Any dispute between you and another user, host, guest, vendor, payment provider, or third party.
  7. Your failure to obtain consent before submitting another person's information.
  8. Your collection, use, misuse, or disclosure of guest information.

27. Copyright Complaints

If you believe content on the Service infringes your copyright, please contact us at support@linktrip.net with information sufficient to identify the copyrighted work, the allegedly infringing material, your contact information, and a statement that you have a good-faith belief the use is unauthorized.

LinkTrip may remove allegedly infringing content and may terminate repeat infringers where appropriate.

28. Dispute Resolution

Please contact us first at support@linktrip.net so we can try to resolve any concern informally.

The following arbitration, class-action waiver, and governing-law language should be reviewed by a qualified attorney before use because enforceability depends on your business structure, location, user base, and applicable law.

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration rather than in court, except that either party may bring a claim in small claims court if the claim qualifies.

You and LinkTrip agree that each may bring claims only in an individual capacity and not as a plaintiff, class member, or representative in any class, collective, consolidated, private attorney general, or representative proceeding.

The arbitration will be conducted by AAA under its applicable rules. The arbitration will take place in Comal County, Texas, unless the parties agree otherwise or the arbitration provider allows remote proceedings.

Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, account security, or the integrity of the Service.

29. Governing Law

These Terms and any dispute arising out of or relating to these Terms or the Service will be governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Subject to the dispute-resolution section above, the state and federal courts located in Comal County, Texas will have exclusive jurisdiction over any permitted court proceeding.

30. Changes to These Terms

We may update these Terms from time to time. When we update them, we will revise the "Last updated" date above.

If we make material changes, we may provide additional notice where required or appropriate. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service.

31. Miscellaneous

These Terms, together with any policies or terms incorporated by reference, constitute the entire agreement between you and LinkTrip regarding the Service.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. LinkTrip may assign these Terms in connection with a merger, acquisition, sale of assets, corporate reorganization, or by operation of law.

We are not responsible for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, internet outages, power outages, government action, payment-processor disruptions, hosting-provider disruptions, app-store disruptions, or third-party service failures.
